Policy and our Agreement of Terms of Use located at the URL

Orco Bank Online is owned and operated by Orco Bank N.V. a corporation
(“Orco Bank”). Orco Bank knows that you care how
information about you is collected over the Internet and shared
with others, so Orco Bank created this Privacy Policy to disclose
our most current policies regarding the use of information collected
from you over the Internet by Orco Bank, including your Personal
Information (as defined below).
Applicability of this Privacy Policy
This Privacy Policy applies to you, Orco Bank, its affiliates,
its contracted third party service providers and the Internet

("Orco Bank Online"). This Privacy Policy is a statement
of Orco Bank's current policies with regard to how information
about you is collected by Orco Bank via Orco Bank Online, used
and managed by Orco Bank and its affiliates, and shared with
other third parties in order to respond to your requests, personalize
your Orco Bank Online experience, and provide financial products
and services to you, including access to your Orco Bank account(s)
via Orco Bank Online.
Orco Bank’s Collection of Personal Information
"Personal
Information" is data and information that specifically
identifies or relates to you and which may or may not be publicly
available. It includes, but is not limited to, your name, your
postal address, your email address, your telephone number, your
demographic information, your credit card number(s), your bank
account number(s), tax information and other relevant information
related to you and your household and finances. It does not
include anonymous aggregate statistics or IP address information

Orco Bank's Use of Your Personal Information
Orco Bank uses your Personal Information within Orco Bank's
internal organization and among its affiliates and other third
party service providers selected by Orco Bank in Orco Bank’s
sole discretion. Potential uses of your Personal Information
include, but are not limited to, one or more of the following:
(i) fulfilling your online banking orders and requests;
(ii) notifying you of promotions, website updates, upcoming
events and new products and services;
(iii) working with credit reporting agencies to determine and
report upon your creditworthiness; and
(iv) as described below, cooperating with regulatory and law
enforcement agencies as permitted and/or required by law.
Orco Bank also reserves the right to share or disclose your
Personal Information when it determines, in its sole discretion,
that the disclosure of such Personal Information is necessary
to identify, contact, or bring legal action against you if you
may be:
(i) causing intentional or unintentional injury to Orco Bank
or another;
(ii) interfering with another’s rights or property, including
Orco Bank’s rights or property; and/or
(iii) violating this Privacy Policy, the Agreement of Terms
of Use and/or any applicable law, rule or regulation, and/or
if such disclosure is required by any applicable law, rule or
regulation and/or is at the request of authorities in the event
of any act of terrorism or instance or local, regional or national
emergency.
Correcting, Updating or Changing Selections Regarding Your Personal
Information
Once you provide Personal Information to Orco Bank, you must
promptly inform Orco Bank of any changes to, or updates of,
your Personal Information. You may at any time request a copy
of the Personal Information, update that information, or change
any selections you have made with regard to Orco Bank's use
of that information. If you close your account(s) with Orco
Bank, we will continue to treat your Personal Information in
accordance with the terms of the most current version of this
Privacy Policy.
In order to access, update or change selections for use of Personal
Information that you provide, please contact Orco Bank either

or via email at online.support@orcobank.com. Orco Bank will
accordingly furnish you with a copy of your Personal Information,
or change its records to remove, update or change selections
regarding your Personal Information.
Orco Bank's Use of Cookies and Other Tracking Practices
Like many other Internet websites, Orco Bank utilizes “cookies”
to automatically track and store preferential information about
you as you use and navigate Orco Bank Online. “Cookies”
are alphanumeric identifiers in the form of text files that
are inserted and stored on your hard drive by your web browser.

to Orco Bank Online, or your Personal Information.

Bank Online may contain links to other Internet websites. Such
links are not an endorsement by Orco Bank of those websites
and/or the companies who own or sponsor them, nor the products
and/or services that may be offered there. Orco Bank makes no
representations or warranties about, nor is it responsible for,
the privacy practices of linked Internet websites. When you
enter a linked Internet website, Orco Bank encourages you to
carefully read the privacy policy of that linked website, as
its privacy policy may differ substantially from that of this
Privacy Policy.
Access and Use by Minors
Orco Bank Online is not intended to be accessed or utilized
by persons under the age of 18. Orco Bank does not intend or
purposefully attempt to award prizes to, or gather information
from, children under the age of 18.

our firm commitment to disclose our current Internet privacy
and confidentiality policies to you. However, Orco Bank reserves

Your Indemnification of Orco Bank N.V.
You shall defend, indemnify and hold harmless Orco Bank and
its officers, directors, shareholders, employees, third party
contractors, agents, representatives and affiliates from and
against all claims and expenses, including, but not limited
to, attorneys’ fees, arising out of, or attributable to:
(i) any breach or violation of this Agreement or our Privacy
Policy by you or anyone logged in under your passwords and/or
access codes, if any; or (ii) your failure to provide accurate,
complete and current Personal Information requested pursuant
to registration.
In connection with the above, the customer agrees and confirms
that Orco Bank is indemnified on our part from and against any
and all possible actions for damages, penalties, costs, and
expenses related to, and resulting from, falsification of, fraudulent
acts and irregularities relating to our Internet contract and
the execution thereof.
Governing Law; Arbitration
This Privacy Policy is to be governed and construed in accordance
with the internal laws of Orco, without regard for principles
of conflicts of laws.
In no event shall you be entitled to punitive, special, indirect
or consequential damages and you hereby waive your respective
rights to any punitive, special, indirect or consequential damages,
including, but not limited to, damages for any loss of profit,
revenue or business, even if Orco Bank has been advised of the
possibility of such damages.
Miscellaneous
If any portion of this Privacy Policy is deemed unlawful, void
or unenforceable, this Privacy Policy as a whole shall not be
deemed unlawful, void or unenforceable, but only that portion
of this Privacy Policy that is unlawful, void or unenforceable
shall be stricken from this Privacy Policy.
The headings contained in this Privacy Policy are for convenience
of reference only, are not to be considered a part of this Privacy
Policy, and shall not limit or otherwise affect in any way the
meaning or interpretation of this Privacy Policy.
All covenants, agreements, representations and warranties made
in this Privacy Policy, as may be amended by Orco Bank from
time to time, shall survive the termination of this Privacy
Policy and/or the termination of your account(s) with Orco Bank.
This Privacy Policy cannot be orally modified or amended.
This Privacy Policy and our Agreement of Terms of Use located

represent the entire understanding and agreement between you
and Orco Bank regarding the subject matter of the same, and
supersede all other previous agreements, understandings and/or
representations regarding the same.
